Man not guilty of rape and kidnap

AN ASYLUM seeker has been found not guilty by a Central Criminal Court jury of kidnapping and raping a Dublin prostitute.

The 38-year-old accused had pleaded not guilty to falsely imprisoning the woman at his flat and raping her three times on March 25-26, 2001.

The jury heard from the accused that the woman had agreed to go to his flat and they had sexual intercourse. He then took a shower and returned to discover £400 was missing from his wallet. He said he told the woman he would not let her go until she returned the money.

The woman told the jury that she had agreed to go to his house for a half an hour for £40, but became frightened when he said he would keep her there all night. She asked to use his phone to call a friend, but in fact called the gardai.

The woman, a chronic heroin addict at the time, denied taking the money or having been desperate for a 'fix' at the time of the incidents.

Investigating officer Det Gda Michael Foley denied the accused had complained of being robbed when gardai arrived at the flat, He insisted that the first he'd heard of missing or stolen money was during the trial.

Rape accused says woman stole £400 from wallet

A FOREIGN national accused of kidnapping and raping a Dublin prostitute has said he detained her in his flat because she had stolen £400 from his wallet.

The 38-year-old accused has denied raping her three times and falsely imprisoning her at his flat on March 25-26, 2001.

In cross-examination by prosecuting counsel, Tom O'Connor SC, he denied his version of the night's events was false.

Using a translator, the accused, an asylum-seeker, told the jury he was on his way home from visiting friends when he met the woman, who he recognised, on the street. He paid her £40 for half an hour and they went to his flat and had sex twice.

The accused said the woman took the money from his wallet while he was having a shower. The alleged victim said she agreed to go to his flat, but while there became frightened and tried to run away before he stopped and raped her. She secretly used his mobile to call 999 and summon help. The hearing before Mr Justice Paul Butler is expected to conclude this morning.
